Terms of Service

Last updated 14 September 2026. These terms govern your use of TopNailed at topnailed.com.

1. Agreement

By using this site or the services on it, you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it.

2. The free tool

The free tool on this site runs in your browser. It is provided as-is, computes on figures you supply, and produces an estimate rather than a guarantee. You may use its output for any purpose, including commercially.

3. Accounts

You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly at hello@topnailed.com if you believe your account has been compromised.

4. Acceptable use

You agree not to:

break the law, or help anyone else do so, using this service;
attempt to gain unauthorised access to any system or account;
scrape, resell or redistribute the service except as these terms allow;
upload malware, or content you have no right to upload;
interfere with the service’s operation or another customer’s use of it.

5. Fees and billing

Paid plans are billed in advance on the cadence shown at checkout. Prices are in USD and exclude taxes. You can cancel at any time from the dashboard; cancellation stops the next renewal and does not retroactively refund the current period except as set out in our refund policy.

6. Your content

You keep ownership of everything you put into the service. You grant us only the licence needed to operate the service for you — to store, process and display your content back to you and to those you share it with. We do not sell customer content, and we do not use it to train models for other customers.

7. Intellectual property

The service, its software and its branding remain ours. These terms grant you a limited, non-exclusive, non-transferable right to use the service, nothing more.

8. Availability

We aim for high availability and publish uptime commitments with paid plans. The free tier is provided without an availability commitment. We may change or discontinue features, and will give reasonable notice before removing something you depend on.

9. Warranties and liability

The service is provided “as is” without warranties of any kind to the fullest extent the law allows. To that same extent, our aggregate liability arising out of these terms is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

10. Termination

You may stop using the service at any time. We may suspend or terminate an account that breaches these terms, and will tell you why unless the law prevents it. On termination you can export your data for 30 days, after which it is deleted.

11. Changes

We may update these terms. Material changes will be notified by email or in-product at least 30 days before they take effect, and the “last updated” date above will change.

12. Governing law and contact
